Thursday, April 23 at approximately 12:30 in the morning, UWG police responded to a complaint call from Arbor View Apartments, building A. Upon arrival, officers spotted a young female in the roadway crying profusely and a young male who was half-way inside the nearby trash compactor.
Officers quickly spotted two kittens laying motionless atop the compactor, and told the male subject to exit the compactor and sit down on the curb nearby before assisting the female off the roadway to the nearby bus stop where she described the incident in detail.
Earlier that night, the male subject had been upset at the female student and had consumed several beers. The student had found four kittens earlier in the day and a pair of friends had taken them off her hands while she was at work. The male subject, a roommate of those friends, killed the kittens by throwing them at full force against the kitchen floor.
Once police had ascertained the sequence of events, they ordered the male student to place his hands behind his back. The student did not comply, questioning the officer about the reason for the order before attempting to flee behind the Arbor View building B.
Police pursued him on foot, ending the chase between buildings B and C with Officer Nottingham tackling him onto the ground. He continued to resist arrest, turning onto his stomach and tucking his hands underneath his body.
Despite warnings that his actions constituted resisting arrest, and that continued failure to comply would result in the use of a Taser, he continued to refuse compliance even as officers fought to pull his arms loose.
Officer Travis Burton applied a stun directly to the subject from his taser that lasted less than three seconds. He continued resisting, and a second stun was delivered. UWG Police Sgt. Dorberth arrived on scene and was able to talk the male into releasing his arms to be handcuffed.
While Officer Burton moved his car to the arrest location to place him in the back seat, the male subject began making several verbal outbursts and continued his attempts to move from the officers on scene, forcing the officers to hold him against the ground.
He then began to insist that he would not move until he spoke with his UWG counselor. Sgt. Dorberth allowed him to speak to the counselor. However, at the conclusion of the call, he would still not stand up to be taken to the car, forcing officers to carry him, though they were not successful in placing him in the car due to continued resistance.
Sgt. Dorberth then requested an ambulance to transport him to be checked out in compliance with the application of the taser. The male again began to physically resist officers attempts to take him to the ambulance and once more Sergeant Dorbert talked him down.
Several City of Carrollton police units and his UWG counselor were present upon the arrival of the ambulance at Tanner Medical Center. Once more, the subject became agitated and resisted attempts to get him out of the ambulance, forcing officers to drag him out of the vehicle.
Six Carrollton officers, one Carroll county sheriff's deputy and Sgt. Dorberth carried him into the Tanner Emergency Room. During this time the subject attempted to kick at the officers several times, once striking Sgt. Dorberth.
The male continued his resistance inside the ER and had to be tasered by Deputy Parish of the Carroll County Sheriff's Office, after which the subject was compliant and placed into a four-point leather restraint on the hospital bed. He then became agitated once more and began yelling at the police officers present, who then departed with the exception of his counselor and Sgt. Dorberth.
After talking to his counselor, he calmed down, allowing staff at Tanner Medical examine him. After being cleared by the staff without further incident, he was transported to the Carroll County Jail for processing.
He was charged with three counts of cruelty to animals, two counts of obstruction and a single count of simple battery. Additionally, GCIC reported that the subject had an outstanding warrant from Carroll County for a probation violation. Chief Mackel of the UWG Police Department stated that the male subject has been removed as a student of the university.
